Gas water heater in a kitchen, is it legal?

Should a gas water heater be in the kitchen next to a gas stove? There is a pipe ( i am assuming this is the vent) that is coming out of the top of the water heater that is going directly into the wall. This is a two story apartment complex with four units. I was told by the realtor that it is safe but I cannot find any information. I have never seen anything like this before. I have never used gas, my utilities were always electric. Any advice or comments would be appreciated. Thank you. Laura

Hi Laura,
Kitchen installations of a water heater are not prohibited by code. For as long as this water heater is properly installed (gas supply, venting, water connections, TPR valve, support / strapping if required in your area) and it has sufficient amount of combustion air provided. Everything has been explained in my articles under the Plumbing / Gas Water Heater category.
 
If you could take a few pictures of this installation (from a distance and close-ups of gas pipes, vent pipe, water pipes) and provide me with a BTU rating (on the manufacturers label attached to the WH) I should be able to tell you if everything has been correctly installed.
